Mr. Kennedy asks that the filing penalty assessed against him be waived under La. R. S. 24:55. He states that he missed the filing deadline by one day due to lack of receiving a timely notification because of an error with respect to his mailing address - the suite number was excluded from the certified mail.
However, Mr. Kennedy was emailed the failure to file email on September 26, 2017, which prompted him to finalize for August. Therefore, there was no need for the Ethics office to send the certified notice of delinquency. The lobbyist is responsible for entering the complete mailing address for the mailing of notices. Mr. Kennedy has since added the suite number to his profile for future mailings through the postal service.
