Advisory opinion request regarding whether Code of Governmental Ethics would prohibit James Tyler from bidding on or entering into a contract to supply lawn services to the Desoto Parish Library System while his wife is employed by the Desoto Parish Library System.
Facts:
James Tyler submitted a request for an advisory opinion regarding whether the Code of Governmental Ethics would prohibit him from bidding on or entering into a contract to supply lawn services to the Desoto Parish Library System while his wife is employed by the Desoto Parish Library System. The Desoto Parish Library has four branches. His wife, Emily Frances Tyler, is employed as a Library Assistant for the Mansfield Main Library. She is not the Branch Manager. Mr. Tyler stated that he has a separate business account that does not include his wife. Additionally, he stated that the Branch Managers supervise the lawn service at each of the four locations.
Law:
La. R.S. 42:1113A prohibits a public servant or a member of such public servant's immediate family or a legal entity in which he has controlling interest from bidding on or entering into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the public servant's agency.
Recommendations:
Adopt draft advisory opinion.
