RE:
Request that the Board waive $660, $300 and $180 campaign finance late fees assessed against Lonny Guidroz, a candidate for District Judge, 18th Judicial District Court, ES 4, Div. A for Point Coupee and West Baton Rouge Parish, in the October 14, 2017 election, whose Special (48 Hour) campaign finance disclosure reports were filed 11, 5 and 3 days late, respectively.
Facts:
Dane P. Falgout, CPA for Lonny Guidroz, states that the reason for the late filing was based on the fact that they did not have knowledge that these reports were required. Once they were made aware of this requirement, he states the reports were submitted immediately. He states it was based on a lack of communication between himself, the Treasurer and the others on the committee that received the contributions. He states that it was not the intention of the committee to disregard the requirements of the Louisiana Board of Ethics Campaign Finance reporting and it would put a financial burden on their account if they had to pay these fines.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.

Recommendations:
Decline to waive for two Special reports with late fees of $660 and $180.

Suspend all based on future compliance for the Special report with a late fee of $300.
