Advisory opinion regarding whether elected Lafayette City-Parish council members may seek employment with non-profit organizations.
Facts:
The attorney for Lafayette City-Parish Consolidated Government (LCG) requested a general opinion as to whether elected Lafayette City-Parish council members may seek employment with non-profit organizations if the employing non-profit has no financial or contractual relationship with LCG and where LCG has no specific regulatory authority over the activities of the non-profit not equally applicable to the general public.
Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant and a legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, from receiving compensation for services rendered to any person who has or is seeking to obtain a business, contractual or financial relationship with the public servant's agency
Recommendations:
Adopt the proposed advisory opinion.
