RE:
Request that the Board reconsider waiving the following late fees assessed against Treme Improvement Political Society; its chairman, Norman R. Smith; and, its treasurer, Paul T. West, concerning the political committee's participation in the October 24, 2015 primary and November 21, 2015 elections: $3,000 for a Special report that was filed 127 days late, $3,000 for an EDE-P report that was filed 114 days late, $3,000 for Special report that was filed 104 days late, and $2,000 for an EDE-G report that was filed 86 days late.
Facts:
In connection with his request that the Board reconsider waiving the late fee assessed for the late filing of the report, Norman Smith states that his PAC does not have any money because all funds received were spent only for the purpose for which it was collected. He states that they have paid a preparer to complete the reports and deeply apologizes for the lateness of the reports.

Mr. Smith states that the report preparer, during the time that the reports were due, was Perryman Schiele. He states Mr. Schiele was instructed to file the reports but failed to do so timely. He states Mr. Schiele has now relocated to Mississippi and they are unable to locate him to retrieve their records.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Affirm decision to decline to waive for the EDE-P, EDE-G and both Special reports.
