Waiver request submitted by Alisa Dunklin, former member of the South Central Louisiana Human Services Authority, regarding a $1500 late fee assessed for failing to file her amended 2014 Tier 2.1 annual pfd.
Facts:
Ms. Dunklin stated that when she was initially appointed (around March 2015) she was unsure of the filing requirements; however, once understood she has timely filed reports with this agency. (Ms. Dunklin provided copies of her certificates showing she completed the ethics training courses for calendar years 2012-2017) The NOD-amend requested that Ms. Dunklin amend the PFD by disclosing the income she received from St. James Parish. In addition to the waiver request, Ms. Dunklin submitted copies of her W-2 IRS Forms (2014-2016) showing income received from St. James Parish. As of this date, an amendment to her Tier 2.1 annual PFD form has not been filed.

Ms. Dunklin stated "... I hope that the board would act favorably to my request as it is not my intention to withhold any information regarding my personal finances..."

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
