Appearance in connection with a request that the Board waive the $600 and $100 campaign finance late fee assessed against John Schroder, a candidate for Treasurer in the October 14, 2017 election, whose Special (48 Hour) campaign finance disclosure reports were 6 and 1 days late, respectively.
Facts:
Amanda Maloy, Campaign Treasurer, for John Schroder, states as prior practice, if a transaction was inadvertently omitted from a 48-hour report, as long as that 48-hour report was filed originally within the time frame allotted, the campaign was not penalized for amending the original 48 report to disclose the omitted transaction. Ms. Maloy requests that the late fees be waived because they have always filed timely and will put additional procedures in place to prevent this from occurring in the future.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Decline to waive for both Special reports.
