Advisory opinion request regarding whether the Code of Governmental Ethics (Code) would prohibit the St. Martin Parish School Board from hiring the daughter of a Superintendent as a licensed speech therapist.

The request has been withdrawn.

Advisory opinion request from the head of HR for St. Martin Parish Schools, Anthony Polotzola, regarding whether the Code of Governmental Ethics (Code) would prohibit the St. Martin Parish School Board from hiring the daughter of a Superintendent as a licensed speech therapist. St. Martin Parish had a population of 52,160 in the April 2010 census.

Law:
La. R.S. 42:1119B(2)(a)(i) permits the school board to employ an immediate family member of the superintendent, provided they are in a parish with a population under 60,000, provided the family member is licensed as a special education related services professional and such family member is the only applicant who meets the qualifications for the position set by the school board who has applied for the position after it has been advertised for at least 30 days in the official journal of the school board.




La. R.S. 42:1119B(2)(a)(iii) provides that within thirty days after the beginning of each school year, any school board member or superintendent whose immediate family member is employed by the school board shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement under this Item may be assessed a late fee of fifty dollars per day, not to exceed one thousand five hundred dollars, subject to the provisions of R.S. 42:1157.
