Appearance in connection with a request that the Board waive the $780 campaign finance late fee assessed against Kevin Kimball, in his capacity as a candidate for District Judge, 18th Judicial District Court, ES 4, Div. A, in the October 14, 2017 election, for filing the Special (48 hour) campaign finance disclosure report 13 days late.
Facts:
Joseph R. Bergeron, Campaign Treasurer for Kevin Kimball, states this is Mr. Kimball's first campaign for elected office. He states he inadvertently overlooked filing a Special 48-hour report relative to a loan made to the campaign by Mr. Kimball's law practice, of which he is the sole proprietor, on September 28, 2017. He states the loan was disclosed on schedule B of the 10-G Report. He states all other reports were filed timely and there was no willful intent by the campaign committee.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
