RE:
Request for approval of a disqualification plan submitted by Chief David McDavid of the Zachary Police Department (Pop. 14,960 in East Baton Rouge Parish) regarding who will participate in transactions in which a communication officer has a substantial economic interest since her spouse is the communications supervisor within the Zachary Police Department (ZPD).
Facts:
Shawntell Johnson serves as the supervisor of the nine employees in the Communications Division within the ZPD. Ms. Johnson only works day shifts while the remaining employees' shifts vary. Ericka Kelly has served as a communications officer under the direct supervision of Ms. Johnson for two years. Ms. Johnson and Ms. Kelly are now immediate family.

The disqualification plan sets Lieutenant Trevor Hannum, the Communications Administrative Coordinator, as the person to participate in the decisions or actions in which Ericka Kelly has a substantial economic interest. This removes Shawntell Johnson from any participation in matters in which Ms. Kelly has a substantial economic interest.


Comments:
The Board previously requested that a disqualification plan be submitted after rendering an opinion that the continued employment of Ms. Kelly would not be prohibited.
Law:
La. R.S. 42:1112B(1) provides that no public servant shall participate in a transaction involving the governmental entity in which, to her actual knowledge, any member of her immediate family has a substantial economic interest.

La. R.S. 42:1112C provides that every public employee, excluding an appointed member of any board or commission, shall disqualify himself from participating in a transaction involving the governmental entity when a violation of this Part would result. The procedures for such disqualification shall be established by regulations issued pursuant to R.S. 42:1134(A)(1).

Recommendations:
Approve the disqualification plan.
