Advisory opinion request by Buddy Amoroso, Baton Rouge Metro City Councilman, regarding whether members of the Zoning Advisory Committee of East Baton Rouge Parish may appear at public meetings held by the East Baton Rouge Planning Commission (Planning Commission) in support of specific projects.
Facts:
In 1998, the Zoning Advisory Committee (ZAC) was established by the Planning Commission to review existing regulations and develop new zoning districts based upon the new land use categories. ZAC is an informal unpaid committee made up of citizens of the parish including architects, lawyers, engineers, developers, homeowner associations and the general public who are confirmed annually by the Planning Commission. It makes recommendations to the Planning Commission on changes to the Unified Development Code (UDC). However, ZAC does not consider specific projects during its meetings. If its recommendations are adopted by the Planning Commission and Baton Rouge Metro Council, they are applied to the entire City-Parish.
Law:
La. R.S. 42:1112D provides that no appointed member of any board or commission, shall participate or be interested in any transaction involving the agency when a violation of this Part would result.
Recommendations:
Adopt proposed opinion.
