Waiver request submitted by Barbara Reich Freiberg, with he East Baton Rouge Parish - Metro Council - District 12, regarding a $2500 late fee assessed for filing her amended 2016 Tier 2 annual pfd 92 days late.
Facts:
Ms. Freiberg stated that she received two NODs from our agency in September 2017. She explained that she believed that both NODs were related to the same position. Therefore, she did not respond to the second NOD. A review of the agency records show that a NOD was issued on 9/12/17 asking that she file a PFD for her position as a school board member. Ms. Freiberg no longer held that position, and for that reason, the NOD was rescinded. A second NOD was issued on 9/22/17 asking that she file a PFD related to her position on the Metro Council. Ms. Freiberg did not respond to that NOD. Ms. Freiberg stated that she later contacted this agency and was informed that the NODs were not related to the same position. Ms. Freiberg then filed the requested amendment. Ms. Freiberg request that the fine be waived. She assures this Board that the error will not happen again. Ms. Freiberg also stated that she would like to make an appearance before the Board.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
