Reconsideration of the Board's denial of a waiver request submitted by Melinda Leblanc Bourgeois, a member of the Jefferson Parish School Board - District 4, regarding a $2500 late fee assessed for failing to file her amended 2015 Tier 2 annual pfd.
Facts:
At the time the Board initially considered her waiver, Ms. Bourgeois had not filed her amendment. Ms. Bourgeois still asserts she filed the pfd on May 3, 2017. However, the pfd received on that date was her 2016 pfd, not the amendment to the 2015 pfd.


Ms. Bourgeois was requested to amend her pfd to disclose income received from the Jefferson Parish School Board.

Ms. Bourgeois stated that she did file the requested documents. She provides a fax transmittal sheet showing transmittal on May 3, 2017 and a copy of her 2016 annual PFD. Ms. Bourgeois does not provide any information related to the requested amendment for her 2015 annual PFD.

A review of her database record confirms that her 2016 annual PFD was received on May3, 2017. As of the date of intiial consideration of her waiver, the amendment to her Tier 2 annual PFD covering 2015 had not been received.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the disclosure requirements under the Code of Ethics.
