Waiver request submitted by Kayla Michelle Henry, Gueydan Chief of Police - Vermilion Parish (Pop. 1398), regarding a $1500 late fee assessed for failing to file her 2015 Tier 3 annual pfd.
Facts:
Ms. Henry stated that she filed at least two PFD's with this agency- in response to notices of delinquency that she received from our agency. Ms. Henry explained that she received a NOD from our agency at the end of 2016 and was personally served with another NOD at the beginning of 2017. She stated that she believed that the NOD that she received in early 2017 was a duplicate of the one she received in 2016. (A review of the database shows that a NOD was issued in December 2016; however, it was returned to our agency as unclaimed.) Ms. Henry stated that she responded to both of the NODs. She stated that she retained the fax confirmation for some time but eventually threw it away; therefore, she does not have a document to prove transmission. Ms. Henry does provide a print out of a text exchange between her and her reporter preparer where she ask for her income. The text is date stamped February 9, 2017.

According to IT, a blank fax was received on February 10, 2017 from the fax number provided by Ms. Henry.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4

of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Waive the late fee.
