Reconsideration of the Board's decision to waive all but $1,050 after considering a waiver request submitted by Mohammad Suleman, M.D., State Board of Practical Nurse Examiners, regarding a $1500 late fee assessed for filing his 2015 Tier 2.1 annual pfd 272 days late.
Facts:
Mr. Becknell, on behalf of Dr. Suleman, requests the Board reconsider and suspend all of the $1500 late fee. He states that although Dr. Suleman is appreciative of the suspension, this is his first late filing. Dr. Suleman is a volunteer and he cannot afford to pay $1,050 to serve on a board when it already costs him to serve as he cannot practice medicine when he is attending meetings.

Attorney John Becknell (on behalf of Dr. Suleman) stated that the failure to timely file the 2015 PFD was not intentional but merely and oversight.

Mr. Becknell also stated that Dr. Suleman has served on the board for eight years and to his knowledge has always filed his disclosure statements timely. Mr. Becknell further stated that because of Dr. Suleman's service on the board it causes a financial loss because of his time spent away from his medical practice.

Attorney Becknell request that the late fee be waived, suspended, or reduced.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Affirm Board's decision to suspend all but $1050 based on future compliance with the reporting requirements under the Code of Ethics. The $1050 is payable within 30 days and if payment is not received within 30 days, the full amount of the late fee becomes due and owing.
