RE:
Request for approval of a disqualification plan submitted by Lauren Berthelot, Finance Director for the City of Plaquemine, and Mayor Edwin Reeves concerning payments for transactions Berthelot's Automotive conducts with the City of Plaquemine.
Facts:
Lauren Berthelot serves as the Finance Director for the City of Plaquemine which oversees the Finance Department. Her husband owns and operates Berthelot's Automotive. All auto repair work, excluding the Plaquemine Police Department, is coordinated through the Public Works Department. If the City Mechanic, Terry Simon, determines a vehicle repair is to be outsourced to Berthelot's Automotive, he will obtain approval of the Public Works Director, Richard Alleman. Mr. Alleman will approve the invoice for payment.

For the Plaquemine Police Department, Police Chief Kenneth Payne or his Assistant Chief, Robert Johnson, makes the determination on whether a vehicle is sent to Berthelot's Automotive for repairs. Accordingly, Chief Payne or Assistant Chief Johnson approves all invoices in this scenario. All checks cut to Berthelot's Automotive for both agencies are cut by the Accounts Payable Clerk, Jacquelyn Salvato, and signed by Mayor Reeves Jr. and Customer Service Director, Monika Edmond.


Law:
La. R.S. 42:1112C provides that every public employee, excluding an appointed member of any board or commission, shall disqualify himself from participating in a transaction involving the governmental entity when a violation of this Part would result. The procedures for such disqualification shall be established by regulations issued pursuant to R.S. 42:1134(A)(1).
Recommendations:
Approve the disqualification plan.
