RE:
Request for an Advisory Opinion from Lionel Wilson, a retired Louisiana Workforce Commission (LWC) employee, relative to working for a company that may have had dealings with the LWC while he was employed there.
Facts:
Lionel Wilson retired from the Louisiana Workforce Commission (LWC) on December 21, 2017. Wilson was employed as a Workforce Development Specialist 4 in the Community Services Block Grant (CSBG) unit whose primary duties included reviewing documents submitted to the CSBG unit by community action agencies of which 21 were public agencies and 21 were private non-profit agencies. In his capacity, Wilson had no authority to make any final decisions relative to contracts, funding, policy or any other actions that directly affected these agencies as that authority was with Wilson's Supervisor. Wilson's duties required that he review financial and activity reports submitted by community action agencies for correctness. Wilson received requests from some of the community action agencies to provide consulting services and assistance on development of plans such as strategic planning, organizational standards, community needs assessment, board training and bylaws and other planning and development relative to the programmatic and operational function of the community action agency. These duties are not related to the work that he performed for the CSBG.


Law:
La. R.S. 42:1121B(1) prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, rendering, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed Advisory Opinion.
