Advisory Opinion request from L. Keith Bartlett, Principal and CEO of the Lycée Francais De La Nouvelle-Orléans Charter School in New Orleans.
Facts:
Benjamin Bhurnke currently teaches multiple grade levels of English & Language Arts at Lycée Francais De La Nouvelle-Orléans Charter School. The parents of a set of triplets currently enrolled in the school have approached Mr. Bhurnke about tutoring services. For the current school year, two of the triplets are not students in Bhurnke's class; however, the other triplet is in his class. Principal Bartlett proposes that Mr. Bhurnke provide tutoring services to the two non-student children for compensation, and that he provide free tutoring services to the student currently in his class.
Comments:
AO 83-59: Tutoring of a teacher's own students for compensation is prohibited by Section 1111C(1)(a). A teacher may tutor, for a fee and outside of normal working hours, students from their school who are not in any of their classes, or students from other schools.


AO 2017-1135: Section 1111C(1)(a) would not prohibit teachers from tutoring for compensation students who attend their school, provided that the students are not being taught by the teacher providing the tutoring.
Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.
Recommendations:
Adopt the proposed advisory opinion.
