Disqualification plan submitted by Keith Stutes, 15th Judicial District Attorney, and Tricia Manceaux regarding participation in transactions involving Liberty National Life Insurance Company and the Office of the District Attorney.
Facts:
A disqualification plan was submitted for approval involving the transaction with Liberty National Life Insurance Company (Liberty National) and the Office of the District Attorney for the 15th Judicial District while the spouse of the Administrative Assistant of the Vermilion Parish Office of the 15th Judicial District is employed by Liberty National. Tricia Manceaux is the Administrator of the Vermilion Office of the 15th Judicial District. Her husband, Kevin Manceaux, is a non-salaried supervising agent for Liberty National who is compensated only through commissions. Neither Tricia nor Kevin Manceaux own any interest in Liberty National.

Keith Stutes has entered into negotiations with Liberty National to provide insurance programs to employees of the Office of the District Attorney who may desire such services. He stated that Kevin Manceaux has not and will not be involved in the negotiation, placement, or servicing of the insurance programs. At all times, this will be determined solely by him and a separate, non-related representative of Liberty National. Tricia Manceaux has not and will not be involved in the negotiation or placement of the contractual arrangements between the Office of the District Attorney or Liberty National. Any additional assistance would be provided by the Finance Director and Human Resources Director of the Office of the District Attorney.

Law:


La. R.S. 42:1111C(2)(d) provides that no public servant shall receive any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are neither performed for nor compensated by any person from whom such public servant would be prohibited by La. R.S. 42:1115A(1) or (B) from receiving a gift.


La. R.S. 42:1112B(1) provides that no public servant shall participate in a transaction involving the governmental entity in which, to her actual knowledge, any member of her immediate family has a substantial economic interest.

La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with the rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.

Recommendations:
Do not approve the disqualification plan.
