RE:
Request that the Board waive the $600 campaign finance late fee assessed against Daniel Ring, a candidate for Councilmember, District A, Orleans Parish, in the October 14, 2017 election, for filing the 10-G campaign finance disclosure report 20 days late.
Facts:
Daniel Ring states that as a first time candidate, he misread the list of candidates that were to file this report and did most of his campaign set up and management on his own. He states he did not sign for the initial certified letter (NOD) indicating that his filing had not been done and prolonged his delay. Had he been one that physically signed for and received it, he states it would have been filed in a much more timely fashion than 20 days late. He states he received the certified mail tag for this letter (Late Fee Order) just the other day even though the date of the tag was 1/10/18.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $200 based on future compliance. The late fee is due within 30 days or the suspended portion becomes due and owing.
