Perry Norcross is a physical education teacher at Benton Elementary in Bossier Parish. He teaches P.E. to students in grades K through 5. His job duties entail teaching archery for four (4) weeks in a classroom setting to 4th and 5th graders. Norcross owns a private business named Norcross Archery where he instructs students in basic to advanced archery. All teaching is done after school, on weekends and during the summer.
Norcross has been approached by schools other than his to conduct a week-long camp at their schools for their students. Norcross does not intend to earn any money for teaching the classes, and any funds generated by the camps will go to the schools' archery programs.
Norcross questioned whether he could tutor students from his school at his home based business, Norcross Archery.

Advisory Opinion 2015-725: the Board advised that the Code of Governmental Ethics would prohibit a teacher from accepting compensation for providing services to students currently in the teacher's class, but not prohibit providing services to former students, students from other public schools, private schools or home schooled students.
Advisory Opinion 2017-1135: the Board advised that the Code of Governmental Ethics would not prohibit teachers at Benjamin Franklin High School from tutoring for compensation students who attend Benjamin Frankly High School, provided that the students are not being taught by the teacher providing the tutoring.

La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject mater of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.
