Advisory opinion request by Oberlin Police Chief Grady Haynes (Allen Parish pop. 1,770) regarding whether it is possible for you to work part-time with the Village of Fenton Police Department (Jefferson Davis Parish pop. 380) while you serve as the Chief of Police for the Town Oberlin.
Facts:
Grady Haynes was re-elected Chief of Police for the Town of Oberlin in 2014 with a term expiring on December 31, 2018. As Chief, he is on call twenty-four hours a day and has a maximum salary of thirty-six thousand dollars. He stated that he and the Village of Fenton Police Chief have come to an agreement whereby he could work five hours a day part-time for the Village. Included in the agreement is that if Chief Haynes is called out in his capacity as Chief of Police for Oberlin, he could leave he part-time employment with the Village at that time. Additionally, he stated that a police vehicle would be issued to him from the Village of Fenton to perform his duties in his part-time capacity.
Law:
La. R.S. 42:1111A(1)(a) provides that no public servant shall receive anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.
Recommendations:
Adopt proposed advisory opinion.
