Advisory opinion request regarding whether the Code of Governmental Ethics would prohibit the City of Bogalusa from entering into a contract for IT services with J-Tech Solutions.
Facts:
Stacy Smith, the Director of Administration for the City of Bogalusa, requested an advisory opinion regarding whether the Code of Governmental Ethics would prohibit the City of Bogalusa from entering into a contract for IT services with J-Tech Solutions. She provided that J-Tech Solutions is owned by Anthony Jones. Mr. Jones is a police officer employed by the Bogalusa Police Department. She has been assured that the work provided by J-Tech Solutions would be separate and apart from Mr. Jones duties as a police officer. J-Tech Solutions has two other employees who can perform the required services while the officer is on duty. She added that the Bogalusa Police Chief is appointed and the Police Department computers are maintained by the City of Bogalusa under this contract. Further, she stated that if J-Tech Solutions was to enter the proposed contract for IT services it would have a duty to maintain the Police Department computers.
Law:
La. R.S. 42:1113A prohibits a public servant or a member of such public servant's immediate family or a legal entity in which he has controlling interest from bidding on or entering into any contract, subcontract or other transaction that is under the supervision or jurisdiction of the public servant's agency
Recommendations:
Adopt draft advisory opinion.
