East Feliciana Coroner Michael Cramer requested an advisory opinion as to whether Section 1112 of the Code of Governmental Ethics would prohibit his office from hiring Steve Bice. Dr. Cramer provided that his office is in need of high quality skilled personnel and he would like to hire Mr. Bice. He provided that Mr. Bice has recently retired from the State of Louisiana Department of Surplus Equipment and he possesses the skills he is looking for in an employee. However, he stated that he currently leases an apartment from Mr. Bice and his wife. He added that there is no formal written contract, that it is a month to month lease.

La. R.S. 42:1112B(5)prohibits a public servant, except as provided in R.S. 42:1120, from participating in a transaction involving the governmental entity in which, to his actual knowledge, any person of which he has an existing contract ... and who by reason thereof is in a position to affect directly the economic interests of such public servant.
