RE:
Waiver request submitted by Craig Michael Marinello, with the Workforce Development Board Area #10, regarding a $1500 late fee assessed for filing his 2015 Tier 2.1 annual PFD 139 days late.
Facts:
Mr. Marinello acknowledged receipt of the NOD. He stated that upon receipt of the NOD he contacted this agency to state that the PFD would be faxed. (Comment in Filemaker database dated 10/13/16 indicates the same.)

A request was made to the IT Division (on 2/28/18) asking if a fax transmittal was received from Marinello from the fax number provided by the Workforce Development Board. A second request was made (on 3/9/18) asking if a fax transmittal was received at any time during calendar year 2016. Search result: No PFD was filed.

Mr. Marinello also stated that in late February 2016, a series of storms plowed through portions of St. John Parish and Laplace area. He stated that he worked with the disaster efforts for several months. Contributing his time to assist with the disaster, may have accounted for the late filing.

Mr. Marinello also requested that he be allowed to make an appearance before the Board when his waiver request is considered.

The Workforce Office also submitted correspondence requested that the late fee be waived. Its reasoning was a restatement of what is contained in Mr. Marinello's correspondence.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all but $650 based on future compliance with the reporting requirements under the Code of Ethics. The $650 is payable within 30 days and if payment is not received within 30 days, the full amount of the late fee becomes due and owing.
