Waiver request submitted by Claire T. Daly, former member of the Acadiana Area Human Services District, regarding two $1500 late fees assessed for filing her 2013 and 2014 Tier 2.1 annual PFDs 90 days late.
Facts:
Ms. Daly explained that she was appointed to serve on the District board in 2013 and has never received any compensation. Ms. Daly further explained that because she served on the board because of her employment with the District Attorney's Office, she used her employment address as her contact address with this agency. Ms. Daly stated that she resigned from her position with the District Attorney's Office in May 2013.

Ms. Daly further explained that when the notices of delinquency were issued to her they were sent to the District Attorney's Office. An employee of that agency signed for them. She stated that one of the notices was sent to her and she immediately filed the PFD. It was not until she received the late fee orders for 2013 and 2014 did she realize that she was being asked to file for those years as well. Furthermore, Ms. Daly stated that she also served on another board where she received no compensation. As a member of that board (Juvenile Justice), she was not required to file a disclosure statement. She, therefore, concluded that she was not required to file a disclosure statement for the Acadiana Area Human Services District either.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Waive the late fees.
