| Advisory opinion request as to whether G & B Works, owned by Trina Brown, may contract with the Red River Parish School Board to perform construction services. |

Trina Brown is currently employed by the Red River Parish School Board (School Board) within the Federal Programs Department as the Parent and Family Engagement Coordinator. Ms. Brown and her husband, William Brown, own equal shares in G & B Works. The School Board is opening bids for a large construction job and William Brown would like to enter a bid for G & B Works to perform some of the work. As an employee within the Federal Programs Department, Ms. Brown would not be involved in the awarding of the contract. Instead, the Business and Maintenance Department within the School Board would oversee the bids and the work performed by the winning bidder.

La. R.S. 42:1113 prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
