Request that the Board waive the $1,000 late fee assessed against Catrice Johnson-Reid, a candidate for Judge, Juvenile Court, Sec. C, Orleans Parish, in the October 2, 2010 election, whose EDE-P report was due October 12, 2010 and was filed 10 days late.

In connection with his request for a waiver of the $1,000 late fee assessed for the late filing of the EDE-P campaign finance report, Wayne E. Woods, on behalf of the candidate and her committee, states that the EDE-P campaign finance report was timely filed, however it was filed on paper form. When the committee was originally formed, it was not expected that the campaign would raise or expend more than $25,000. Accordingly, when it became clear that the campaign had raised more than $25,000, an Electronic Filing Affidavit was filed on or about September 29, 2010. Following the filing of the Electronic Filing Affidavit, it was not until October 22, 2010 that an id and password was provided. It was not until the afternoon that the LEADERS software was successfully downloaded and the report was successfully filed electronically. Ms. Johnson is a major level candidate. This is her first election.



The IT Dept confirms that it received an affidavit for an electronic password on Friday October 1, 2010. A member of the IT left a message for Mr. Woods on Monday October 4, 2010. That call was not returned so a member of IT called again on October 7, 2010. Mr. Woods would return the call and then a member of IT would call again and leave another message. The information requested was not received until October 22, 2010.

Law:
Under new law now in effect a District or Major level candidate that has more than $25,000 in activity in connection with an election must file reports electronically. The report is not considered filed until it is filed electronically.

Recommendations:
Reduce fee to $100.
