(Former) Representative Stephen Ortego stated that when he initially received the notice of delinquency on October 21, 2016, he thought the notice was issued in error because he was not serving in the legislature at that time. He stated that he contacted this agency shortly thereafter and was told that he was not required to file a PDF. He stated that he contacted our agency again in late October or early November 2016 to verify that he was not required to file and was told that he was required to file but that a late fee would probably not be assessed.
A review of the database record shows a call being received from Mr. Ortego on December 1, 2016, where he was informed that he was required to file a PFD covering 2016 because his term ended on January 11, 2016. A second call was made to our agency on December 5, 2016 requesting confirmation that his PFD was received. There are no other records of telephone calls from Mr. Ortego until a telephone call was received on July 27, 2017, requesting that a return call be made to inquire about the late fee notice/order. Mr. Ortego request that he be allowed to make an appearance.

La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4
of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
