Request that the Board waive the $240 late fee assessed against Dan Hollingsworth, a candidate for Mayor, City of Ruston, in the October 2, 2010 election, whose Special report was due by September 25, 2010 and was filed 6 days late. |

ELECTION: October 2, 2010 TYPE OF REPORT: Special DAYS LATE: 6 ASSESSED FEE: $240 REPORT DUE: September 25, 2010 REPORT FILED: October 25, 2010 ACTIVITY REPORTED: $16,929.21 in loans received OTHER LATE FILINGS: None
In connection with his request for a waiver of the $240 late fee assessed for the late filing of his Special campaign finance report, Don M. McGehee, campaign treasurer for Dan Hollingsworth, states that the candidate's campaign received loans in excess of $250. There are two reasons why the omission of the loans were not included in a Special report: 1) the monies were never deposited into the candidate's campaign account; and 2) the use of the loans were unknown to him, the campaign treasurer, until after the due date for the Special report.
The loans were not reported until the filing of the 10-G campaign finance disclosure report. Further, the loans in question were for three direct expenditures by the candidate from the candidate's personal funds in payment of campaign expenses. Since the loans were created from a direct expenditure from the candidate's personal funds, he was unaware of the creation of the loan at the time the loan was created.
Mr. Hollingsworth is an any other level candidate. This is his fifth election.
