Advisory opinion request by Port Barre Chief of Police Deon Boudreaux regarding whether he can conduct concealed carry classes and charge a fee.
Facts:
Deon Boudreaux was elected as the Chief of Police of Port Barre in February 2008. As Chief, the Town of Port Barre provides for the ammunition, lodging and fuel for the police unit for you to attend POST firearms instructor training starting in 2010. Port Barre also pays for the annual renewal training through ammunition and use of the police unit. He applied to become a concealed carry instructor by sending a copy of his post certification and course syllabus to the Louisiana State Police Conceal Carry Office. He does not train any of his employees in concealed carry education. The concealed carry classes he would teach would be located at a private business or public range. Finally, all equipment used to conduct these concealed carry classes would be his own private property.
Law:
La. R.S. 42:1111A(1)(a) provides that a public servant shall not receive anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities.
Recommendations:
Adopt proposed advisory opinion.
