Advisory opinion request by Ronald "Todd" Gibson, Chief of Police for the Town of Haughton, regarding whether he can hire the son-in-law of his current Assistant Chief of Police, Ricky Bridges.
Facts:
The position Chief Gibson is trying to fill in the Haughton Police Department would be assigned to patrol division and would be directly supervised by a patrol sergeant.

The position of the Assistant Chief of Police acts in the capacity as the chief administrative officer for the Haughton Police Department. Both sergeants in the Department report directly to the Assistant Chief who reports directly to Chief Gibson. Assistant Chief Bridges is responsible for handling and resolving issues in which the two sergeants he supervises cannot. He is also responsible for approving all the reports, vacation or sick slips, and scheduling. The only involvement Assistant Chief Bridges would have involving the patrol position is monthly scheduling. Assistant Chief Bridges' son-in-law is Antonio Mims.

Law:
La. R.S. 42:1119A provides that no member of the immediate family of an agency head shall be employed in his agency.

La. R.S. 42:1102(3) provides that "agency head" means chief executive or administrative officer of an agency or any member of a board or commission who exercises supervision over the agency.

Recommendations:
Adopt proposed opinion.
