Advisory opinion request as to the applicability of any post-employment prohibitions found in Section 1121 of the Code of Governmental Ethics on Jason Curole, a former employee of the Coastal Protection and Restoration Authority (CPRA) and /or his employer, GHD Services, Inc.
Facts:
Mr. Curole requested an advisory opinion as to the applicability of any post-employment prohibitions found in Section 1121 of the Code of Governmental Ethics on him, a former employee of the Coastal Protection and Restoration Authority and /or his employer, GHD Services, Inc. Mr. Curole provided that his current employer seeks to solicit and conduct business with his former agency, CPRA. He stated that GHD is an international engineering and environmental consulting company that performs coastal engineering and environmental work throughout the world. GHD seeks to provide services to CPRA through both a professional services mechanism and a consulting services mechanism. Mr. Curole stated that he would not provide any service that he provided while he worked at CPRA on any project that he participated in as a CPRA employee while employed at GHD.



Mr. Curole stated that he worked for CPRA from 2011 to 2018. From 2011 to 2013, Mr. Curole was employed in CPRA's Operations Division in Thibodaux Regional Office as a project monitor; and, from 2013 to 2018, in CPRA's Management Division as a project manager. Mr. Curole managed and monitored projects. Mr. Curole stated that he understands that the Code would prohibit him from assisting GHD in any of the projects that he participated in while employed at CPRA.
Law:
La. 42:1121B(1) prohibits a public servant, for a period of two years following the termination of his public employment, from assisting a person for compensation in a transaction in which he participated or from rendering any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt draft advisory opinion.
