RE:
Request that the Board waive the $800 late fee assessed against Jeanne Nunez Juneau, a candidate for Judge, 4th Circuit Court of Appeal, in the October 2, 2010 election, whose EDE-P campaign finance disclosure report was due by October 12, 2010, and was filed 8 days late.
Comments:
ELECTION: October 2, 2010
TYPE OF REPORT: EDE-P
DAYS LATE: 8
ASSESSED FEE: $800
REPORT DUE: October 12, 2010
REPORT FILED: October 20, 2010
ACTIVITY REPORTED:$894 in activity

OTHER LATE FILINGS: None

In connection with his request for a waiver of the $800 late fee assessed for the late filing of the EDE-P campaign finance report, Leonard P. Alphonso, on behalf of Jeanne Nunez Juneau, states that the report was mailed to the address listed on the form. The postal service returned the correspondence as not deliverable to the address noted on the report. However, the returned correspondence was not received until after receiving a delinquency notice from the Campaign Finance division. The report was filed immediately upon receipt of the delinquency notice.

The copy of the returned envelope indicates that the report was originally mailed on October 15, 2010 and the report was due October 12, 2010 so the report was still 3 days late.

Ms. Juneau is a major level candidate. This is her first election.

Recommendations:
Reduce the late fee to $300.
