RE:
Advisory Opinion request from Brian Shedd, Assistant Director of the Office of Innovation & Technology Commercialization, relative to post-employment restrictions.
Facts:
Brian Shedd was employed as the Assistant Director of the office of Innovation & Technology Commercialization (ITC) located on the LSU campus in Baton Rouge from November 30, 2015 until December 15, 2017. Mr. Shedd was responsible for assisting the ITC Director in managing, encouraging, and supporting the development, disclosure, and protection of institutional inventions and intellectual property. Mr. Shedd reported to the Assistant Vice President for Research - Technology Transfer and the Director of ITC. In his position, Mr. Shedd had no supervision responsibility.

Mr. Shedd would like to consult and/or teach for other colleges and departments within the LSU system, such as the College of Engineering or the College of Business.

Additionally, Mr. Shedd would like to provide consulting services to companies that interacted with and continue to interact with ITC. Mr. Shedd's focus on commercialization activities would be limited to business and strategic planning, fund raising, customer development, product development and prototyping, manufacturing and distribution. Mr. Shedd would not provide any assistance on the management of any intellectual property and any agreements that he may have participated in while at ITC.

Law:
La. R.S. 42:1121B(1) prohibits a former public employee, for a period of two years following termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
