Advisory opinion request by Gerald A. Turlich, Jr., Plaquemines Parish Sheriff, regarding whether the employees of the Plaquemines Parish Sheriff's Office (PPSO) may use The Ferry Stop, which is owned by a full-time employee of PPSO and his wife, to refuel their departmental vehicles.
Facts:
Urban Treuil is an employee of PPSO who is assigned to the Patrol Division- District 3, which is located on the east bank of Plaquemines Parish. He does not supervise any employees but is assigned a departmental vehicle. Mr. Treuil and his wife own The Ferry Stop.
PPSO maintains approximately two hundred eighteen (218) vehicles, of which twenty-eight (28) are assigned to the east bank between the District 3 Patrol Division and the Plaquemines Parish Detention Center. The Sheriff estimates that approximately three thousand three hundred eighty-five (3,385) gallons of fuel per month would be purchased from The Ferry Stop if such purchases were not prohibited. The next nearest fueling station near the north end of the parish is located approximately 1.3 miles into St. Bernard Parish; however, this fueling station is not a 24 hour facility like The Ferry Stop.
Law:
La. R.S. 42:1113A(1)(a) prohibits public servants, or members of such a public servant's immediate family, or a legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt proposed opinion.
