Advisory Opinion request from Cliff Dore, Training Director, St. Martin Parish Sheriff's Office.
Facts:
Cliff Dore is employed by the St. Martin Parish Sheriff's Office as the Range Master and Training Director. Concealed carry classes are not offered to the public by the St. Martin Parish Sheriff's Office and are not a part Mr. Dore's public duties as Range Master or Training Director.

Mr. Dore would like to utilize the St. Martin Parish Sheriff's Office firing range to conduct the classes. The range availability would require approval by the St. Martin Parish Sheriff.

Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 42:1113A(1)(a) states no public servant, excluding any legislator and any appointed member of any board of commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

AO 2018-259: Port Barre Chief of Police not prohibited from conducting private concealed carry classes since the classes were not a part of the police dept.'s programs or responsibilities.

AO 2009-156: Acadia Parish Sheriff's Office Training Director not prohibited from conducting private concealed carry classes since the classes were not a part of the Sheriff's Office programs or responsibilities.

Recommendations:
Adopt the proposed advisory opinion.
