Consent opinions regarding Wiley Robinson, Mayor of the Town of Plain Dealing, Bossier Parish, population 1,015, his sons' company, Custom Herbicides, Inc., and Aaron Bufkin related to the purchase of a fire truck owned by the Town of Plain Dealing.
Facts:
The consent opinions have been signed by all parties and Wiley Robinson has paid the $2,000 civil penalty.


Law:
La. R.S. 42:1112B(1) prohibits a public servant from participating in a transaction involving his governmental entity in which a member of his immediate family has a substantial economic interest.

La. R.S. 42:1113A(1)(a) prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1117 provides that no public servant or other person shall give, pay, loan, transfer, or deliver or offer to give, pay, loan, transfer, or deliver, directly or indirectly, to any public servant or other person any thing of economic value which such public servant or other person would be prohibited from receiving by any provision of this Part.

La. R.S. 42:1117.1 provides that no public servant or other person shall transfer any thing of economic value or any asset, interest, or liability to any person or governmental entity for the purpose of circumventing any provision of this Chapter, unless such transfer is irrevocable.

Recommendations:
Adopt and publish the consent opinions and dismiss charges.
