RE:
Request that the Board waive two $280 campaign finance late fees assessed against Denis Jordan, in his capacity as a candidate for Mayor, Town of New Llano, Vernon Parish in the March 24, 2018 election, whose 10-P and 10-G campaign finance disclosure reports were filed 7 and 7 days late, respectively.
Facts:
Denis Jordan states for his first report he had help from a current council member. He states that during the campaign process it became clear that he had a good chance of unseating the incumbent and she was close friends with him. At that point, he states the assistance stopped, which caused the 10-P report to be filed late. As to the 10-G report, he states he was unaware of this report having to be filed due to him not being in a general election because he won the election during the primary election. He states that missing the filing deadline was due to an oversight on his behalf, but the report schedule was also not clear about which reports need to be filed if the campaign ends after a primary election. He states he was laid off shortly after the campaign started and is living off his VA compensation. If a waiver is not possible, he requests that the Louisiana Board of Ethics be willing to extend the time to pay the fees until mid to late August so that he can use the paycheck he will be drawing as mayor.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

18:1495.4D(1) If the final report of a candidate for an election, as required by Paragraph (5), (6), or (7)of Subsection B of this Section, shows a deficit or a surplus, the candidate and his treasurer, if any, shall file supplemental reports with the supervisory committee of all information required in R.S. 18:1495.5. Such reports shall be filed annually no later than February fifteenth and shall be complete through the preceding December thirty-first. Such a supplemental report shall be filed each year until a report has been filed which shows no deficit and until any surplus campaign funds have been disposed of in accordance with R.S. 18:1505.2(I). The report on surplus funds shall disclose the disbursement of such funds in the same manner as expenditures are reported.

Recommendations:
Decline to waive for both reports and offer Mr. Jordan a payment plan.
