RE:
Request that the Board waive the $1,000 campaign finance late fee assessed against Antonia Caine, a candidate for Councilman / District 4, City of Baker, East Baton Rouge Parish, in the March 5, 2016 election, whose 10-G campaign finance report was 322 days late.
Facts:
Antonia Caine states that this is her first time as a candidate and she misunderstood the requirement for the filing of the 10-G report because she didn't have any funds available and the reports were so close that she thought that only one report was due. She states that she has a strong desire to become an elected official, and therefore would never purposely omit a process that would hinder that goal.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $100 based on future compliance. The late fee is due within 30 days or the suspended portion becomes due and owing.
