Advisory Opinion request from Henry Lafont on behalf of Andrew Martin and the Greater Lafourche Port Commission.
Facts:
Andrew Martin has been in negotiations with the Greater Lafourche Port Commission since 2006 regarding a tract of land located in Galliano. The tract would connect the proposed bridge across Bayou Lafourche with Highway 3235 and provide direct access to the South Lafourche Airport. Mr. Martin is now considering running for a seat on the Port Commission in the upcoming election.
Law:
La. R.S. 42:1102(19) defines a "public servant" as a public employee or an elected official.

La. R.S. 42:1102(9) defines "elected official" as any person holding an office in a governmental entity which is filled by the vote of the appropriate electorate.


La. R.S. 42:1113A(1)(a) states no public servant, excluding any legislator and any appointed member of any board of commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.



Recommendations:
Adopt the proposed advisory opinion.
