Advisory Opinion request from Rhonda Reap-Curiel, President of Louisiana Industrial Development Executives Association ("LIDEA").
Facts:
LIDEA is a statewide trade association for professional economic developers and affiliates. LIDEA's members include private and public employees, including employees of LED. LIDEA and LED are partnering with other organizations and individuals to provide economic and community development training to those who are interested in learning how to grow their communities. The trainings will be held in Monroe, Natchitoches, and Hammond. As part of the educational program, LED employees will travel to these locations and present information related to their area of expertise and job responsibilities.
Law:
La. R.S. 42:1115.1 provides that the total value of the food, drink, or refreshment given to a public servant at any single event shall not exceed sixty one dollars.

La. R.S. 42:1115.2 - effective August 1, 2018 provides that the Code shall not preclude the acceptance by a public servant of complimentary admission, lodging, and reasonable transportation, or reimbursement for such expenses, if the agency head of the public servant's agency certifies that the acceptance is either of direct benefit to the agency or will enhance the knowledge or skill of the public servant as it relates to the performance of his public service, and the agency head approved of the acceptance prior to acceptance. Any public servant who accepts complimentary admission, lodging, or transportation, or reimbursement for such expenses, shall file with the Board, within 60 days of acceptance, a certification disclosing the required information.

NOTE: Act 200 repeals the previous exception in 1123(41) regarding admission, travel, and lodging expenses and the required affidavit.


Recommendations:
Adopt the proposed advisory opinion.
