Advisory opinion request concerning post-employment restrictions that would apply to Joe Harris following the termination of his employment with the Governor's Office of Homeland Security and Emergency Preparedness (GOHSEP).
Facts:
Joe Harris was employed at GOHSEP as a Disaster Recovery Specialist in the Grants Management section in November 2009. His duties included processing payments, providing guidance and assistance to sub-grantees associated with the Hazard Mitigation Grant Program. At no time was he ever a director or supervisor while employed by GOHSEP until his resignation on January 12, 2018. Mr. Harris is currently seeking employment with companies such as Deloitte, GRC and APTIM who have won bids to handle public assistance grants and public assistance grant closeouts. While employed by GOHSEP, Mr. Harris never worked on public assistance grants or had any direct contact with Deloitte, GRC and APTIM.
Law:
Section 1121B of the Ethics Code prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction involving the agency of the former public employee, in which the public employee participated at any time during his public employment. Additionally, Section 1121B prohibits a former public employee, for a period of two years following the termination of his public employment, from rendering the same service which he rendered during his public employment on a contractual basis to, for, or on behalf of his former agency.
Recommendations:
Adopt the proposed advisory opinion.
