RE:
Request that the Board reconsider waiving the $440 campaign finance late fee assessed against David Merlin Duke, a candidate for City Prosecutor, City of Bogalusa, in the November 4, 2014 election, whose 2017 Supplemental campaign finance disclosure report was filed 11 days late.
Facts:
David Merlin Duke states that on February 15th he was in court all day and attended a meeting until 7:45 pm. He states that the report deadline escaped his mind. Additionally, he states there was a delay in the mail delivery as shown on the attachments to his letter causing an additional four-day delay and the report was filed the day he received the notice. He stated he has instituted a procedure to avoid this situation in the future. He asks for a suspension or reduction of fine to reflect the delay caused by the post office.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $280 based on future compliance. The late fee must be paid within 30 days or the suspended portion becomes due and owing.
