Advisory opinion request regarding Steven Williams' employment as a firefighter with Winn Parish Fire District #3 while his father-in-law serves as one of its appointed board members.
Facts:
Steven Williams first became a volunteer firefighter with the Winn Parish Fire District #3 ("District") beginning on September 5, 2016 and was hired by the District as a part-time firefighter on October 6, 2016. Mr. Williams married the daughter of William Martin, an appointed board member of the District, on July 15, 2017. Mr. Williams was promoted to a full-time firefighter position on February 13, 2018. William Martin abstained from voting as a District Board member related to this promotion.
Law:
La. R.S. 42:1119A prohibits an immediate family member of an agency head from being employed in his agency.

La. R.S. 42: 1119C(2) allows a public servant who has been employed with an agency for at least one year prior to his immediate family member becoming an agency head to maintain his employment and to receive normal promotional advancements.

Recommendations:
Decline to render an advisory opinion.
