RE:
Request that the Board waive the $360 and $300 campaign finance late fees assessed against Tonya S. Lurry, a candidate for District Judge, 18th JDC, Pointe Coupee and West Baton Rouge Parishes, in the March 24, 2018 election, her committee's chairperson, Jamie E. Fontenot, and treasurer, Donovan Dugas, whose Special (48 Hour) campaign finance disclosure reports were filed 6 and 5 days late.
Facts:
Jamie E. Fontenot, campaign manager for Tonya S. Lurry, states the campaign contributions in question were reported timely, however, she reported the incorrect date received, the checks were dated April 19, 2018, and she erroneously put that wrong date. She stated the report was an amended correcting the dates. She states she would greatly appreciate it if the late fee would be waived as this was merely a clerical error on her part.

She states she was unaware that "loans" in excess of $500 were required to be reported as well. She states she has no defense to this, other than her ignorance. She states the $2,000 loan was reported, however, just untimely because she did not know it needed to be included on the special report. She would ask to consider suspending the $360 for this infraction with the condition that Judge Lurry hire somebody to take over responsibility for these reports.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Decline to waive for the special report with the late fee of $360.

Rescind the $300 late fee for the other special report.
