The Athletic Director of Captain Shreve High School has requested an advisory opinion relative to paying a faculty member and a non-faculty person to maintain the baseball facilities in the Fall. The faculty member would be someone who does not have job duties associated with maintaining athletic facilities, would not be employed in the athletic department, nor would be employed in the maintenance department. The non-faculty member would be a student worker from a local college. Baseball season runs from the month of January until the month of May, at which time coaches provide the maintenance of the facilities. The payment of maintenance people during the Fall would come out of the school baseball account.

La. R.S. 42:1111A(1)(a) prohibits a public servant from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.
