Request for an advisory opinion relative to the post-employment restrictions in the Ethics Code that apply to Eli Wilson, who retired as a Network Specialist with the St. Tammany Parish Clerk of Court's office.
Facts:
Eli B. Wilson retired from the St. Tammany Parish Clerk of Court's office on April 17, 2018. Wilson was employed as a Network Specialist who provided phone support to local attorneys, title companies and members of the general public with regard to problems accessing the Clerk's public records website. Wilson made purchase requisitions to purchase computer hardware and software, but was not involved in any outside sales of any kind. The Clerk's office contracted with Netchex, a computer software vendor, that serviced the office payroll and human resources processing.
Law:
La. R.S. 42:1121B prohibits a former public employee, for a period of two years following the termination of his public employment, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, rendering, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
