Advisory Opinion request of Brendan Greene, Executive Counsel, on behalf of Michelle Craig, Commissioner with the City of New Orleans Civil Service Commission.
Facts:
Michelle Craig, an attorney licensed to practice in the State of Louisiana, is a Commissioner with the City of New Orleans Civil Service Commission ("Commission"). She has been approached by the Non-Flood Protection Asset Management Authority ("Authority") within the Orleans Levee District, regarding the establishment of an attorney-client relationship. Part of Ms. Craig's representation may include appearances before the State Civil Service Commission in matters involving the discipline of employees in the classified service within the State Civil Service System. Ms. Craig's representation of the Authority before the State Civil Service System would not be related in any way to her service on the Commission, as the Commission has no jurisdiction over the Orleans Levee District, which is a political subdivision of the State.
Law:
La. R.S. 42:1111E(1) provides that no public servant, and no legal entity of which such public servant is an officer, director, trustee, partner, or employee, or in which such public servant has a substantial economic interest, shall receive or agree to receive anything of economic value for assisting a person in a transaction, or in an appearance in connection with a transaction, with the agency of such public servant.

La. R.S. 42:1102(16) defines "person" as an individual or legal entity other than a governmental entity, or an agency thereof.

Recommendations:
Adopt the proposed advisory opinion.
