Request that the Board consider an untimely waiver for four $2,000 campaign finance late fees assessed against Ferrante "Coach" Dominique, a candidate for Member of School Board / At Large, Iberville Parish, in the November 4, 2014 election, whose 30-P, 10-P, and 10-G campaign finance disclosure reports were filed 1351, 1330, 1300 days late, respectively, and the EDE-P campaign finance disclosure report was not filed.
Facts:
Ferrante "Coach" Dominique states he was under the impression that if he didn't accept any donations, no report needed to be filed with the exception of the initial report. He can honestly say that he was emotional and didn't totally read the packets because after buying signs and push cards he wouldn't accept any donations. He states he was running an independent word of mouth campaign.


He states that the Board of Ethics sent him a certified letter to a temporary address that he used while working in Pineville, Louisiana in April 2017. He states this was over 20 months after he had filed for bankruptcy in September 2015, which was a year following the election. Had he known about these fines he states his attorney, Kipp Walls, would have included these fines in his bankruptcy.

He paid all late fees prior to qualifying for the November 2018 election.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Consider the untimely waiver request due to Mr. Dominique's medical issue at the time the late fee orders were served.

Decline to waive the $2,000 for the 30-P report.


Suspend all but $200 for each of the 10-P, EDE-P and 10-G reports (total due $600) based on future compliance. The late fees must be paid within 30 days or the suspended portion becomes due and owing.
